EU KOM: Aufforderungsschreiben an vier Mitgliedstaaten

Die EU Kommission bittet 4 Mitgliedstaaten (Estland, Lettland, Litauen und Protugal) um Informationen in Bezug auf nationale Vergaberechtsregelungen. Ein Aufforderungsschreiben stellt die erste Stufe eines förmlichen Vertragsverletzungsverfahrens [1] dar. Hintergrund der Aufforderungsschreiben ist, dass die Mitgliedstaaten verpflichtet waren, die Regelungen der Vergaberechtsmodernisierungsrichtlinien 2014/24/EU, 2014/25/EU und 2014/23/EU bis zum 18. April 2016 in nationales Recht umzusetzen. Die Aufforderungsschreiben stellen nun eine Überprüfung der Richtlinienkonformität dar.

Public procurement: Commission asks 4 Member States to provide information on their national public procurement and concessions rules

The Commission decided to send letters of formal notice to Estonia, Latvia, Lithuania and Portugal regarding the conformity of their national legislation with EU rules on Public Procurement and Concessions. The new rules (Directive 2014/24/EU [2],Directive 2014/25/EU [3] and Directive 2014/23/EU [4]) had to be transposed by Member States into national law by 18 April 2016. These letters are the result of the compliance checks undertaken by the Commission to see whether national legislation complies with the EU Directives. They follow letters of formal notice to 15 Member States in January 2019 [5] on the same matter. Today’s decisions complete the first round of checks for all the Member States by addressing Member States where transposition was completed with important delays, and therefore required later assessments. It is without prejudice to any potential follow-up action of the first package from January 2019. Member States have now two months to reply to the arguments put forward by the Commission. Otherwise the Commission may decide to follow up with a reasoned opinion.
